      1. Definition and Interpretation

1.1   In these terms:

“Company” means AccessPanelsUk.com

“Customer” means the purchaser of Goods from the Company.

“Goods” means all goods sold and/ or delivered by the Company to the Customer.

“Terms” means these terms and condition of sale.

      2. Ownership of Site Agreement:

Access Panels reserves the right, at its sole discretion, to change, add or remove portions of these Terms and Condition, at any time. It is your responsibility to check these terms periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these terms of Use, Access Panels grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

3. Application:

3.1   These Terms apply to all contracts for sale of Goods by Company.

3.2   No amendment, alteration, waiver or cancellation of any of these Terms is binding on the Company unless confirm by the Company in writing.

3.3   The Customer acknowledges that no employee or agent of the Company has any right to make any representation, warranty or promise in relation to the Goods or the sale of the Goods other than as contained in these Terms.

4. Prices:

4.1   Prices are determined at the time of order and, prior to payment of the deposit, are subject to change without notice.

5. Payments:

5.1   Payments are to be made to the Company without any deduction or discount other than as stated in these Terms or in relevant invoice or statement.

5.2   A deposit of 50% of the invoice price must be paid when placing an order.

5.3   Where Goods are ordered with texture or colour selected by Customer, the item must be paid in full at the time the deposit is paid.

5.4   The balance of the invoice price must be paid in full before delivery of Goods.

5.5   Interest is payable on all overdue accounts calculated on daily basis at the rate of 2% above the prevailing Bank of England’s base rate on the outstanding balance until such time as the balance is paid in full and final settlement. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in event that the outstanding balance does not exceed £3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

5.6   Cash or Personal Cheque with Bankers Card, all major Credit/Debit Cards or BACS Transfer are all acceptable methods of payment. Our Terms are payment in full within thirty days. All goods remain the property of the Company until paid for in full.

5.7   Returned cheques will incur a £25 charge to cover banking fees and administrative costs. In an instance of a second Returned cheque, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

6. Shipping and Delivery:

6.1   Turnaround: All orders are shipped within 24 hours Monday-Friday 8am-5pm and Saturday 8am-12:30pm.

6.2   Carriers: We use the following carriers to deliver our orders, Royal Mail, UPS, TNT and My Hermes.

6.3   Order Tracking: If a Tracking number is provided by shipping carrier, we will update your order with tracking information. Please note that some orders using 2nd class Royal Mail will not have tracking numbers.

6.4   Shipping Rates: The rate charged for the shipping of your order is based on the weight of your products, and your location. Before the final checkout page you will be shown what the cost of shipping will be, and you will have the chance to not place your order if you decide not to.

6.5   Back Order: If an item goes on back order we will ship you the part of your order that is in stock. When the item becomes available we will ship you the rest of your order. You will not be charged any additional shipping and handling for second shipment.

6.6   The Customer must, within 5 days of being notified of their availability, collect or accept delivery of the Goods and pay the balance of the Invoice price.

6.7   If the Customer fails to collect the Goods or accept delivery within 21 days of being notified of their availability, Access Panels may terminate this contract, keep the deposit and resell the Goods.

6.8   Access Panels reserves the right to deliver the Goods in whole or in installments, as well as to deliver prior to the date of delivery and, in such event, the Customer must not refuse to take delivery of Goods.

6.9   Any failure on the part of the Company to deliver installments within specified time does not entitle the Customer to repudiate the contract with regard to the balance remaining undelivered. The delivery date is only an estimate of where the product will be shipped. Company assumes no liability for loss, damage or consequential damage due to delay. Company reserves the right to make delivery in installments (including both advance shipments and back orders) unless Customer expressly states otherwise in Customer’s purchase order.

7. Privacy:

7.1   What information Do we Collect? We only collect information that we need that is related to your order. This includes your Billing Address, Shipping Address, E-mail Address, Credit Card Information or Debit Card details. In addition we also collect information on your IP address, browser type, and Refer URL data. We use this data to prevent hacking attempts, help us know what web browsers people are using, and find out where our visitors are coming from so that we can improve our marketing.

7.2   How is My Information used? Your information is only used to fill your order. We do not sell or redistribute your information to Anyone.

7.3   Security and Storage: Only your order data billing, shipping, and order contents data is stored on our server. We do not store your Credit Card data.

7.4   Others: It may be necessary – by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence – for Access Panels to disclose your personal information. We may also disclose information if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate. We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.

7.5   Cookies and Browser Information: Cookies are small files that reside on your computer and allow us to recognize you on your next visit or store your shopping cart contents. We use them only to track this information.

8. Returns, Refunds and Exchanges

8.1   How to Return an Item: Your item must be in its original unused condition to be returned, unless there is a manufacturer defect. You must return the item within 8 to 10 days of your purchase.

8.2   Please email info@accesspanelsuk.com  to request a refund and we will assign you a tracking number; Mail your returned item to: Access Panels uk, 15 Verderers Road, Chigwell, Essex, IG7 4LZ, London; Include in your package a signed letter stating the reason for your return and the original receipt.

8.3   Return Exceptions: Some items cannot be returned if they are opened. Merchandise that has been used or altered will not be accepted for return or exchange.

8.4   Restocking Fee: We do not refund the original shipping and handling that you paid on the order.

8.5   Exchanges: If your purchase is unopened and in new condition, you may exchange your purchase for a different item or colour. However, you still will have to pay return shipping.

9. Violation of these terms

9.1   Access Panels may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with Access Panels rights or property, or the rights or property of visitors to or users of the Site, including Access Panels customers. Access Panels reserves the right at all times to disclose any information that Access Panels deems necessary to comply with any applicable law, regulation, legal process or governmental request. Access Panels also may disclose your information when Access Panels determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

9.2   You agree that Access Panels may, in its sole discretion and without prior notice, terminate your violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Access Panels, for which monetary damages would be inadequate, and you consent to Access Panels obtaining any conjunctive or equitable relief that Access Panels deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Access Panels may have at law or in equity.

9.3   If Access Panels does take any legal action against you as a result of your violation of these Terms and Condition, Access Panels will be entitled to recover from you, and you agree to pay, all reasonable solicitors’ fees and costs of such action, in addition to any other relief granted to Access Panels. You agree that Access Panels will not be liable to you or to any third party for termination of your access to the Site as a result of these Terms and Condition.

10. Our Site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

11. Our Liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

·         All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

·         Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any loss or damage of any kind, however arising and weather caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of damage to your tangible.

·         To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes.

·         To carry out our obligations arising from any contracts entered into between you and us.

·         To allow you to participate in interactive features of our service, when you choose to do so.

14. Viruses, Hacking and other offenses

You must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via denial-of-service attack or a distributed denial- of service attack.

By breaching this provision, you would commit a criminal offense under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial of service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of site or to your downloading of any material posted on it, or on any website linked to it.
